How to Cancel a Timeshare Contract in Turkey
Because timeshare and long-term holiday-service contracts involve high-value commitments that bind the consumer for many years, the law provides broader protection in these contracts than in general sales contracts.
Definition of a Timeshare Contract
Under Article 50 of Law No. 6502, a timeshare contract is one concluded for a period longer than one year that provides the consumer with one or more nights' accommodation for more than one period. A long-term holiday-service contract, meanwhile, covers contracts of longer than one year that give the consumer an accommodation discount or other benefits.
The Right of Withdrawal
The consumer has the right to withdraw from timeshare and long-term holiday-service contracts within 14 days, without giving any reason and without paying a penalty. Where the seller fails to fulfil its disclosure obligation regarding the right of withdrawal, this period may extend up to three months.
The Prohibition on Advance Payment
Under Article 53, taking any advance payment from the consumer under any name, a deposit, a guarantee, drawing up a promissory note, or entering into a similar obligation is prohibited during the withdrawal period. Amounts collected in violation of this prohibition must be refunded to the consumer.
Withdrawal in Credit-Financed Contracts
Where the timeshare price is financed through credit and the consumer exercises the right of withdrawal, the credit agreement also terminates automatically; the lender cannot claim any interest, commission, or other expense from the consumer under any name.
Terminating the Contract Later
Even after the withdrawal period has passed, if the seller breaches the contract (such as a breach of the disclosure obligation or failure to provide the promised services), the consumer may seek termination of the contract and damages under the general provisions.
Practical Recommendations
Before signing a timeshare contract, check whether the seller holds an authorisation certificate from the Ministry of Trade and carefully review the pre-contractual information form. If an advance payment is requested, refuse it and document the situation.
