Frequently Asked Questions

How is a compensation claim initiated after a traffic accident?

A written application is first submitted to the traffic insurer of the vehicle involved in the accident; if the insurer fails to respond within 15 days or the offer is inadequate, an application may be made to the Insurance Arbitration Commission or the courts.

What can be done if the insurance company rejects the claim?

The grounds for rejection are examined against the policy terms; if found unjustified, an objection is first lodged with the insurer, and if unsuccessful, an application is made to the Insurance Arbitration Commission or the general courts.

Is there a fee for applying to the Insurance Arbitration Commission?

Applications concerning disputes below a certain threshold are free of charge; above that threshold, a modest application fee applies. Commission decisions are generally reached more quickly than court judgments.

Which insurance applies in a traffic accident?

Compulsory third-party motor insurance covers the other party's losses, while your own comprehensive (kasko) policy, if you have one, covers damage to your own vehicle.

What happens if the insurer fails to conclude my claim file on time?

If payment is not made within the statutory period, the insurer falls into default, and the insured may additionally claim interest on the overdue amount.

Can the policy be terminated before its term expires?

Yes, the parties may terminate the contract before its term in the cases provided by law and the policy conditions; the consequences of termination may include a pro-rata refund of premium.

How is the beneficiary determined in a life insurance policy?

The policyholder may freely designate the beneficiary in the policy and change this designation during the term of the insurance; if no beneficiary is designated, the indemnity is generally paid to the heirs.

What are the consequences of not declaring a pre-existing condition in health insurance?

Failure by the policyholder to declare a known material condition may, upon occurrence of the insured event, allow the insurer to withdraw from the contract or reduce the indemnity paid.

Can an expert appraisal report be challenged in a kasko claim?

Yes, an insured who disagrees with the expert appraisal's findings may object; if the dispute continues, recourse may be had to the Insurance Arbitration Commission or the courts.

What risks does business (workplace) insurance cover?

Coverage varies by policy; guarantees such as fire, theft, natural disaster and third-party liability may be offered separately or as a package policy.

Does coverage continue if I pay the premium late?

If the premium is not paid on time, the insurer's liability may be suspended at the end of the statutory notice period, so it is important to keep track of the payment schedule.

Does applying to insurance arbitration affect my right to sue?

Applying to arbitration against a member insurer generally replaces the right to sue directly, though the possibility of objecting to the appeal arbitration panel is preserved.

For which buildings is DASK (compulsory earthquake insurance) mandatory?

DASK is mandatory for registered residential dwellings within municipal boundaries; without this insurance, land registry transactions and certain other official procedures generally cannot be completed.

What can I do if I am harmed by an insurance agent's error?

Since the agent acts on behalf of the insurer it represents, the insurer may generally also be held liable for harm resulting from the agent's fault.

If I cancel my insurance policy, is the premium I paid refunded?

If the contract ends before its term, the portion of the premium corresponding to the unexpired period is generally refunded to the insured.
