How to Object to a Turkish Tax Penalty

A taxpayer who receives a notice following a tax audit has more than one available route, and using them in the right order and within the right deadlines shapes both the penalty itself and the course of collection.

What Penalties Can Arise?

Under Articles 341-344 of the Tax Procedure Law (VUK), failing to fulfil tax-related obligations on time or in full gives rise to a tax loss penalty; where the tax loss results from fraudulent conduct, this penalty is applied at three times the amount. In addition, irregularity and special irregularity penalties may be imposed for breaches of formal obligations.

Two Separate Routes: Settlement or Litigation

After the notice is served, the taxpayer may request post-assessment settlement (uzlaşma) or file a lawsuit directly with the tax court. If settlement is requested but not reached, the deadline to file suit is automatically extended — the two routes are not mutually exclusive and can be pursued in sequence.

The Deadline to File Suit

Under Article 7 of the Administrative Procedure Law (İYUK), the deadline to file with the tax court is, as a rule, thirty days. If settlement fails, this period begins to run afresh from notification of the settlement-failure record, for whatever time remained of the original period, or fifteen days if less than fifteen days remained.

Collection Is Automatically Suspended

Under İYUK Art. 27/4, filing a lawsuit with the tax court automatically suspends collection of the disputed tax, duty, fee or similar financial obligation. This is a significant safeguard specific to tax litigation, since it applies without the need for a separate stay-of-execution request otherwise required in general administrative proceedings.

Practical Recommendations

Establish the exact date the notice was served, and assess together with a lawyer or accountant which route — settlement or litigation — better fits your situation. Attending a settlement meeting unprepared can narrow the defence options available in any later lawsuit.
