How to Apply to the Consumer Arbitration Board in Turkey

The consumer arbitration board is an administrative body that resolves consumer disputes falling below a statutory monetary threshold more quickly and free of charge, compared to the courts.

In Which Disputes Is Applying Mandatory?

Under Article 68 of Consumer Protection Law No. 6502, applying to the arbitration board is mandatory for consumer disputes below the monetary threshold announced annually by the Ministry of Trade; if a lawsuit is filed directly for a dispute below this threshold, the court will dismiss it on procedural grounds for lack of jurisdiction. For disputes above the threshold, the consumer may apply directly to the consumer court.

Where and How to Apply

The application is filed with the provincial or district consumer arbitration board where the consumer resides or where the transaction took place, together with the application form and supporting documents (invoice, contract, correspondence). The application can also be filed electronically through the Consumer Information System (TÜBİS).

Whether the Board's Decision Is Binding, and Objections

Arbitration board decisions are binding and final for the parties in disputes below the amount set by law; decisions above that amount may be objected to before the consumer court within 15 days of notification. On objection, the court reviews the board's decision and rules again.

Enforcing the Decision

A board decision that becomes final without objection is treated as an enforceable document and can be pursued through enforcement proceedings. A seller or provider who fails to comply with the decision is also subject to an administrative fine.

Practical Recommendations

When completing the application form, clearly state your request (refund, replacement, repair, price reduction) and attach a copy of all supporting documents. Checking beforehand whether your dispute amount is above or below the current monetary threshold ensures you apply to the correct body.
