Objecting to a Zoning Plan in Turkey and the Annulment Action Deadline

Posting of the Zoning Plan and the Objection Period
Under Article 8 of Zoning Law No. 3194, an approved zoning plan is posted and announced by the relevant administration for a period of one month; anyone wishing to object to the plan may file an objection with the relevant administration within this one-month posting period.
Filing Suit Directly, Without Objecting
A property owner who wishes to file suit directly without first objecting must file an annulment action with the administrative court within sixty days of the day following the last day of the plan's one-month posting period; this period runs in parallel with the general sixty-day filing period under Administrative Procedure Law No. 2577.
The Filing Deadline After Objecting
Where an objection to the zoning plan is filed within the posting period, the filing period begins to run again from the date the objection is implicitly or explicitly rejected; suit must be filed within sixty days of notification of the administration's decision rejecting the objection.
The Hierarchy of Zoning Plans
Zoning plans are subject to a hierarchy running from the larger-scale master plan down to the smaller-scale implementation plan; an implementation plan conflicting with the master plan is one of the most commonly raised grounds of unlawfulness in an annulment action.
The Relationship Between the Building Permit and the Zoning Plan
In an action against acts such as the refusal or annulment of a building permit, the underlying zoning plan on which those acts are based can also be challenged; if the zoning plan is annulled, permits issued based on it also lose their legal foundation.

Track the date the zoning plan was posted and the end date of the posting period; if you believe the plan negatively affects your property, decide together with a lawyer whether to first object to the administration or file suit directly.
