Objecting to a Refused Residence Permit

The refusal of a residence permit application, the cancellation of a permit already granted, or the failure to extend it, is an administrative act that directly affects the right to stay in Turkey; legal remedies exist against such a decision.

The Grounds for Refusal

Under Law No. 6458 on Foreigners and International Protection (YUKK), a residence permit application may be refused on grounds such as posing a threat to public order, public security or public health, submitting a forged document, lacking a valid purpose of residence, or missing required documents. The reasoning stated in the refusal decision is decisive in shaping the objection strategy.

The Administrative Objection and Litigation Route

Administrative decisions taken under the YUKK — including the refusal, cancellation, or non-extension of a residence permit — can be challenged before the competent administrative court within seven days of notification. Unlike general administrative litigation deadlines, the law provides for an expedited review period for such cases; the court examines the file as a priority and issues a decision within a short time.

Legal Status During the Proceedings

Filing suit does not, as a rule, automatically suspend deportation on its own; it is therefore very important to request a stay of execution together with the lawsuit. If a stay is granted, no action can be taken based on the current situation until the case concludes.

The Option of Reapplying

Instead of filing suit against the refusal decision, it is also possible to submit a fresh application with new documents and information that address the grounds for refusal; however, this route does not remedy any unlawfulness in the earlier decision — it simply starts a new evaluation process.

Practical Recommendations

Keep the document showing the notification date and the reasoning of the refusal decision; since the seven-day filing deadline is very short, it is crucial to consult a lawyer as soon as you receive the decision. Setting out concretely in the petition why the refusal's grounds are unjustified directly affects the outcome of the process.
