Objecting to an Enforcement Proceeding in Türkiye: Deadlines, Remedies and Consequences
When you are served with an enforcement proceeding against you, the first and most critical step is to file the correct objection within the deadline.
What Is the Deadline for Objection?
In enforcement proceedings without a court judgment, an objection must be filed with the enforcement office within seven days of service of the payment order. This deadline is strict; if missed, the proceeding becomes final.
On What Grounds Can an Objection Be Filed?
An objection may be based on grounds such as the debt having been paid in whole or in part, the debt being time-barred, the proceeding having been initiated before an enforcement office lacking jurisdiction, or the debt never having arisen. An objection to the signature and an objection to the debt itself are subject to different procedural rules, and it is important to distinguish between them correctly.
What Are the Consequences of an Objection?
An objection filed within the deadline automatically suspends the proceeding. For the proceeding to continue, the creditor must apply to the enforcement court to have the objection removed, or file an action to set the objection aside.
What Is an Action to Set Aside an Objection?
Through this action, which the creditor must file within one year of the objection being served, the creditor seeks to prove that the debtor's objection was unjustified. If the action succeeds, the proceeding resumes from where it left off, and the debtor may be ordered to pay compensation for wrongful objection of up to 20% of the claim.
How Does It Differ from a Negative Declaratory Action?
Even after a proceeding has become final, a debtor may file a negative declaratory action to prove they owe no debt; however, this action does not, as a rule, suspend the enforcement proceeding, and where payment has already been made it becomes a restitution action instead.
